These Terms and Conditions of Use (“Terms”) apply to the AYS Transfers & Travel website (the “Site”). The Site is owned and operated by AYS Transfers & Travel and its licensors. By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, you must not use this Site.

AYS reserves the right, at its sole discretion, to modify, update, add or remove portions of these Terms at any time without prior notice. It is the user’s responsibility to review the Terms periodically. Continued use of the Site constitutes acceptance of any changes.

AYS may change or discontinue services, routes, schedules, or prices at any time without notice and makes no commitment to update the content of the Site.

Privacy Policy

AYS Transfers & Travel respects your privacy and is committed to protecting your personal information. Our Privacy Policy explains how we collect, use, store, and protect your data.

When purchasing shuttle or transfer services, customers are required to provide personal information such as full name, email address, passenger details, and payment information. Failure to provide complete and accurate information may result in our inability to provide the service.

Payment information is processed through secure third-party payment gateways. AYS does not store full credit card details.

AYS reserves the right to update its Privacy Policy at any time. We encourage users to review it regularly.

Disclaimer

AYS reserves the right to modify rates, schedules, itineraries, or services at any time and may arrange alternative transportation or cancel services when necessary.

AYS shall not be held liable, directly or indirectly, for losses, damages, delays, missed or delayed flights (including arrivals or departures), injuries, or additional expenses caused by third-party service providers, airline schedule changes, flight delays or cancellations, or circumstances beyond its control.

Indemnification

By using this Site, you agree to indemnify and hold harmless AYS Transfers & Travel, its owners, employees, affiliates, agents, and partners from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Site or violation of these Terms.

Account Security

Some areas of the Site may require account credentials. Users are responsible for maintaining the confidentiality of their account information and for all activities conducted under their account.

AYS is not responsible for losses resulting from unauthorized access due to user negligence. Any suspected security breach must be reported immediately.

Required User Conduct

Users agree to:

  • Provide truthful and accurate information
  • Not harass, threaten, abuse, or impersonate others
  • Not upload offensive, defamatory, illegal, or harmful content
  • Not transmit viruses or malicious software
  • Not collect personal data of other users
  • Not use the Site for unauthorized commercial purposes
  • Not send spam, bulk messages, or unsolicited promotions

Violation of these rules may result in suspension or termination of access without notice.

Reservation & Operational Policy

AYS provides private and shared shuttle transportation throughout Costa Rica.

All services:

  • Require advance reservations
  • Operate hotel-to-hotel only
  • Must include passenger names, dates, and confirmed pickup and drop-off hotels

Passengers without confirmed reservations will not be allowed to board, even if seats are available.

Fares & Schedule Changes

  • Fares are listed per segment and include applicable taxes.
  • Changes to routes, dates, or times may result in additional charges or refunds.
  • Schedules are not guaranteed and are subject to change without notice.
  • AYS is not responsible for missed connections or schedule changes.

Luggage Policy & Liability

  • Liability for lost or damaged checked luggage is limited to the actual value or USD $600, whichever is less.
  • AYS assumes no liability for:
    • Carry-on items
    • Normal wear and tear
    • Contents of luggage
    • Protruding parts (wheels, handles, straps)
    • Items left unattended in vehicles
  • Only standard luggage is accepted. Oversized or overweight items may be refused.
  • One checked bag and one carry-on per passenger are included at no extra cost.

Children & Accessibility

  • Children under 12 must be accompanied by an adult (18+).
  • Unaccompanied minors under 12 are not accepted.
  • All children count as a passenger
  • Manual wheelchairs are accepted; motorized mobility devices are not.
  • Guide dogs are allowed under owner responsibility.

Refund Policy

  • Refund eligibility depends on cancellation policies.
  • Credit card refunds are issued only to the original card and may take 22–30 business days.
  • No refunds are issued after travel has commenced unless required by law.
  • Some services are non-refundable.

Force Majeure

AYS is not liable for delays, cancellations, or failure to complete services due to circumstances beyond its control, including weather conditions, strikes, natural disasters, public disturbances, or acts of terrorism.

Legal Jurisdiction

All disputes arising from these Terms shall be governed by and interpreted under the laws of the Republic of Costa Rica.

Limitation of Liability

All services and content on this Site are provided “as is”, without warranties of any kind.

To the maximum extent permitted by law, AYS’s total liability shall not exceed the minimum amount required by applicable law.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain valid and enforceable.

Feedback

Any feedback or suggestions submitted to AYS shall be considered non-confidential and may be used without restriction.
